It's sad but true, that in Texas, employers are not mandated to carry workers compensation / work comp insurance for their injured workers. In fact, Texas is the ONLY state that is like that, here in the United States. One estimate found that about forty (40) percent of employers in Texas DO NOT carry workers compensation insurance on their employees, and about sixty (60) percent do. This means , statistically, you have a 4 in 10 chance of being injured at a job that does not offer work comp insurance coverage in Texas. For those employers who have decided NOT to offer work comp coverage to their employees, they may be sued by the worker for injuries sustained on the job ( I'm not an attorney, but that is my understanding of the situation). If they DO offer workers compensation coverage, the Work Comp system is the "exclusive remedy" for the injured worker, meaning they CANNOT sue their employer for on the job injuries, but instead, must resort to working their problems and issues through the bureaucracy.
